  • SERVICE DELIVERY CHALLENGES RECEIVING ATTENTION AS KZN COGTA MEC HLOMUKA HANDS OVER WATER TANKER AND FIRE FIGHTINGVEHICLE AT NDWEDWE

    Ndwedwe: The plight of the rural communities of Ndwedwe received a major boost this morning when KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka handed over a water tanker and a state-of-the-art fire fighting vehicle to assist this rural municipality in improving access to water for its residents and strengthening its disaster management capacity.

    Hlomuka was joined by Mayor of the District Cllr S Gumede and Ndwedwe Mayor Cllr N Chili who welcomed this investment by the department into building capacity within the district which comprises some of the most rural municipalities in the province.

    During the handover, Hlomuka stressed his department’s commitment to supporting municipalities in fulfilling their constitutional mandate of providing services to communities.

    This rural municipality experienced a tragedy last year when five people died in a house fire in Mthebeni, Ward 11. The fire truck handed over by Hlomuka today will be a major boost to the municipality’s ability to respond to such incidents. “Today’s handover is a significant milestone in our efforts to improve the safety of our communities and speed up the response time by our fire and rescue teams whenever they are called upon,” said Hlomuka.

    During the visit, Hlomuka also handed over a water tanker which is a short-term intervention by the department to alleviate the plight of rural communities within the municipality.

    The truck is fully funded by Cogta and will serve areas within the Ndwedwe local municipality which is one of the areas that still fall behind in terms of water provision.

  • KZN COGTA MEC HLOMUKA PARTICIPATES IN PROVINCIAL LEGISLATURE’S 2021 SCHOOL MONITORING PROGRAMME

    KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka this morning took part in the Harry Gwala District Schools functionality programme, where he was joined by the Mayor of the District, Cllr Nxumalo, and Members of the Provincial Legislature which were led by Hon Hlobisile Dlamini.

    The aim of the programme is to assess the state of readiness of schools to commence with teaching following the opening of schools across the province.

    The delegation visited the Nkumba and Dlangala Primary in the Nkosazana Dlamini-Zuma municipality.

    During the visit, the delegation interacted with the management of both schools on some of the challenges they are faced with and some of the interventions that can be made to resolve them.

    These issues ranged from provision of water, structural damage to schools, pass rates, tools of trade for teachers, and the provision of PPE for teachers and leaners.

  • KZN COGTAMEC COMMENDS KZN MUNICIPALITIES FOR HONOURING ESKOM DEBT

    KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka has welcomed positive developments in the payment of debt owed to Eskom by municipalities in the province.

    Yesterday, Eskom KZN issued a statement commending the department’s intervention which has been a key factor in municipalities being able to honour their payment plans.

    According to Eskom some of the municipalities have been able to pay off their electricity debt like eDumbe and Abaqulusi. With other municipalities are on the verge of finishing like Msunduzi and Inkosi Langalibalele.

    MEC Hlomuka has commended the Management within the department for the excellent work they have done in mediating between Eskom and municipalities.

    Hlomuka believes that the positive developments being noted did not happen by themselves but took great effort from the department through the deployment of senior officials to mediate between the municipalities and Eskom with a view to finding a workable solution that would allow the municipalities to pay off their debt monthly at a sustainable rate.

    This breakthrough in the mediation efforts led to the signing of payment plans by Eskom with all these municipalities.

    Prior to the signing of the payment plans municipalities such as eDumbe, Mthonjaneni, Abaqulusi, Inkosi Langalibalele, Msunduzi, Ulundi and Mooi-Mpofana were facing the possible risk of their electricity supply being interrupted as a result of the debt they owed to Eskom.

    Following the intervention of the department the following municipalities have settled their debt:

    ·       eDumbe which owed R6.2-million

    ·       Mthonjaneni which owed R6.9-million, and

    ·       Abaqulusi which owed R36.1-million

    “We have also seen remarkable progress in the Inkosi Langalibalele municipality. They owed Eskom an amount of R104- million and have been able to pay off 90% of this debt. In the Msunduzi municipality, the original debt owed was R203-million. They have been able to pay 78% of the debt. In both these municipalities, the full settlement of their debt is expected to take place at the end of this month” adds Hlomuka.

    The Mooi-Mpofana and Newcastle municipalities are continuing to honour their payment plans.

    MEC Hlomuka has also noted that the Ulundi municipality has chosen to terminate its electricity supply agreement with Eskom, which is a situation the department is mediating in to ensure the best possible outcome is reached – one that will be in the best interest of the community.

    MEC Hlomuka has also noted telling contributions by the Administrators in the municipalities that are under Section 139(1) b intervention such as Abaqulusi, Msunduzi and Inkosi Langalibalele which were able to pay their debt faster.

    KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka has today announced the appointment of Bamba Ndwandwe as the administrator of the uMkhanyakude district municipality.

    Hlomuka met with the full council of the district municipality this morning to officially inform its members of the decision taken by the Provincial Executive to place the municipality under administration in terms of Section 139(1)b of the Constitution.

    In the meeting, Hlomuka explained to the council that the decision to institute this intervention is the culmination of Cogta’s previous efforts to address long-term dysfunctionality at the district whose governance system has suffered due to internal divisions and failure to convene council for three consecutive scheduled meetings.

    “Some of the consequences of this frequent and persistent breakdown of council meetings at uMkhanyakude include the council’s failure to table completed forensic investigation reports or the municipality’s precarious cash flow position and resultant failure to meet its financial commitments” said Hlomuka.

    As part of the intervention, the Provincial Government has now assumed the functions specified in terms of Sections 51, 56 and 57 of the Municipal Systems Act as well as those related to financial management.

    Ndwandwe who is now the ministerial representative at uMkhanyakude will be based at the municipality where he will prepare and implement a recovery plan to:

    ·       ensure the implementation of financial systems, policies and procedures including preparation and implementation of cost-cutting measures,

    ·       establish and act as chairperson of the interim finance committee to monitor and manage the cash flow of the municipality, approve or dis-approve purchase requisitions and to ensure that the municipality’s cash position is not overdrawn,

    ·       implement governance systems and procedures, including oversight over the administration and ratification of decisions taken by the council, the Executive Committee, committees, Municipal Manager and Section 56 Managers in terms of delegated or original authority,

    ·       ensure the implementation of findings arising from any investigations into fraud or maladministration or corruption,

    ·       ensure the finalisation of unauthorised, irregular, fruitless and wasteful expenditure reports and any consequence management emanating from the outcome of the reports tabled with the council, and

    ·       institute all disciplinary processes that will be deemed necessary.

    Hlomuka has urged the uMkhanyakude district council to work together with the newly appointed administrator to address the challenges that have led to the municipality being placed under administration.

    ANNOUNCEMENT OF SECTION 139(1)b INTERVENTION AT UMKHANYAKUDE DISTRICT MUNICIPALITY

    Honourable Speaker and Councillors

     

    We have called this virtual meeting today to address you on a very important matter of ensuring good governance, sound financial management and efficient service delivery as a set of prerequisites for long-term stability of this district municipality. 

     

    The residents of this district rightly expect a well-run entity but what they actually see has a lot to be desired. It is therefore our duty as Cogta, following the resolution of the Provincial Executive, to make an important announcement before this council regarding the immediate future of this municipality. 

     

    We are here to support and assist, not to point fingers and penalise, because we respect the sphere of local government as a separate and independent arm of government. uMkhanyakude district is one of the jewels of our province and we wish it to shine again.

     

    Purpose of the address

     

    The purpose of today’s address is to apprise this council of the Provincial Executive’s decision to intervene in this district municipality in terms of section 139(1)b of the Constitution to restore this municipality’s functionality in terms of proper governance, administration and, by extension, service delivery. 

     

    You will recalled that the Provincial Executive intervened in this municipality in October 2015, also in terms of Section 139(1)b of the Constitution. That intervention was informed by the assessment that for a number of years, this municipality had been limping from one problem to another. There were persistent governance, financial and service delivery challenges that the municipality had been unable to resolve despite support from the provincial and national governments. 

     

    This municipality subsequently made good progress in all key performance areas that informed the decision of the Provincial Executive to intervene here in 2015. As a result of these developments, the Provincial Executive terminated the intervention in November 2017. Two years later, it appears that this municipality has slipped back to instability and dysfunctionality.

     

    Background and summary

     

    The decision to institute this intervention is the culmination of Cogta’s previous efforts to address long-term dysfunctionality at uMkhanyakude district whose governance system has suffered due to chronic internal divisions amongst to the extent that it has failed to convene council for three consecutive scheduled meetings. The council’s failure to convene meetings has had serious implications for the administration and service delivery as crucial decisions cannot be made. 

     

    Some of the consequences of the frequent and persistent breakdown of council meetings at uMkhanyakude due to internal divisions within this council include the council’s failure to table completed forensic investigation reports or the municipality’s precarious cash flow position and resultant persistent failure to meet financial commitments.

    This municipality has also exhibited failure to address matters raised by the Auditor-General for the 2018/2019 financial year, poor revenue collection, inadequate credit control measures, poor project management and supervision or under-expenditure on repairs and maintenance due to the fact that it does not have a planned and preventative maintenance programme in place, nor funds to finance such a programme.

     

    We are now of the firm view that there are no prospects for recovery from the breakdown in governance in the near future and that the effects of this are detrimental to service delivery. Such an environment warrants a strengthened role of the Provincial Government which is available under Section 139 of the Constitution.

     

    Way forward

     

    Going forward, I as MEC for Cogta, am therefore announcing an intervention in terms of Section 139(1)b of the Constitution, 1996, at uMkhanyakude district to assume the functions specified in terms of Sections 51, 56 and 57 of the Municipal Systems Act as well as those related to financial management. 

     

    To this end, we are appointing a representative to be based at this municipality who will prepare and implement a recovery plan to:

    It is time for a fresh start in this municipality. After a long period of instability and poor results, the people of uMkhanyakude deserve that we give them a municipality they can be proud of through our hard work and flawless performance. The challenge for us here is to make sure that this municipality will soon live up to its promise of maintaining infrastructure, including roads, managing waste and delivering basic services to its communities. 

     

    As an elected municipal council, you are now urged to accept this new temporary arrangement and cooperate with our ministerial representative to ensure a smooth running of this municipality and its return to normality until this intervention is formally called off.

  • KZNCOGTA MEC CONDEMNS MURDER OF INKOSI CELE OFUMDONI DURING VISIT TO CELE HOUSEHOLD

    Cooperative Governance and Traditional Affairs (Cogta) MEC Sipho Hlomuka yesterday paid his respects to the family of the late Inkosi Sifiso Derrick Cele, 47, of the KwaCele Traditional Council in the uMdoni Local Municipality.

    Inkosi Cele was assassinated on Wednesday evening by unknown gunmen who raided his house and opened fire on Inkosi fatally wounding him.

    MEC Hlomuka visited to households of Inkosi Cele in Dududu, where he paid his respects to the family of Inkosi.

    During the visit MEC Hlomuka condemned the senseless attack on Inkosi and called for law enforcement agencies to leave no stone unturned in pursuit of those that murdered Inkosi.

    In the visit, MEC Hlomuka was accompanied by the Mayor of the uMdoni Local Municipality Cllr S.T Khathi and the Chairperson of the Ugu Local House of Traditional Leaders Inkosi Shinga.

  • KZN COGTA MEC HLOMUKA SENDS CONDOLENCES FOLLOWING THE PASSING OF NDWEDWE DEPUTY MAYOR

    KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka has expressed his shock and sadness at the passing of the Deputy Mayor of Ndwedwe local municipality, Cllr Nokulunga Esther Blose.

    Cllr Blose passed away yesterday at the hospital after a short illness. She had served diligently as a member of the Executive Committee, and also as the chair of the Human Resources Committee. She was patient, hardworking and her passing leaves a huge void in the sphere of local government.

    “As the sphere of local government in KZN, we have lost yet another leader of our people. We mourn with the Ndwendwe community and the family of municipalities under the Ilembe district the loss they have suffered. During this difficult time, the family and those who worked closely with Cllr Blose remain in our thoughts and prayers,” said Hlomuka.

    Cooperative Governance and Traditional Affairs (Cogta) MEC Sipho Hlomuka has learned with shock and dismay of the assassination of Inkosi Sifiso Derrick Cele, 47, of the KwaCele Traditional Council in the uMdoni Local Municipality.

    Inkosi was attacked last night by unknown gunmen who opened fire on him while he was at his home. In the attack, Inkosi suffered fatal injuries and sadly passed away while being transported to hospital.

    MEC Hlomuka has condemned this senseless murder which is an attack on the institution of traditional leadership in the province.

    Hlomuka has called upon law enforcement agencies to leave no stone unturned in the pursuit of the cowards responsible for this act of cowardice.

    The MEC has also sent condolences to the family of Inkosi and the KwaCele Traditional Communities for this tragic loss they have suffered.

    MEC Hlomuka has appealed to residents to come forward with any information that might assist law enforcement agencies on these developments.

  • SEVERE RAINS EXPECTED IN KZN THIS WEEKEND, COGTA MEC HLOMUKA ORDERS HIGH ALERT FOR DISASTER TEAMS

    KZN MEC for Cooperative Governance and Traditional Affairs (Cogta) Sipho Hlomuka has directed disaster management teams across the province to be on high alert as more rains are expected this weekend in the northern parts of KZN.

    The latest report received from the South African Weather Service indicates that there is a severe risk of flooding due to the tropical storm that is expected to descend on the province this weekend.

    Currently, disaster management teams are dealing with floods in the uThukela district where towns, such as Ladysmith and Winterton, have seen their roads flooded as a result of the persistent heavy rains.

    Engineers in both these towns are working to resolve some of the challenges posed by the build-up of water.

    In Ladysmith displaced residents have been provided with shelter in the indoor sports complex. Community halls have been opened in all the affected areas.

    A Joint Operations Committee for Disaster Management in the uThukela District is meeting daily to devise a way to mitigate the impact of the flooding and to prevent any loss of life should the water level continue to increase.

    Hlomuka has deployed disaster management teams to all affected areas within the uThukela district to provide interim relief to communities.

    The MEC has also appealed to residents to continue to exercise extreme caution as the coming rains could exacerbate the current situation with a number of areas and communities facing the prospect of floods.

    So far, KZN has lost eight lives as a result of the inclement weather conditions that started on 24 January due to tropical depression Eloise. The fatalities include a 3-year-old child that was swept away when her mother was crossing a river in Ulundi.

    Hlomuka has directed disaster management teams to work closely with community structures, such as ward committees and traditional councils, to ensure that residents in areas that face the risk of flooding are sufficiently warned and assisted should the need arise.

    The department will be continuing to monitor these developments and communicate any new measures to communities.

  • KZNCOGTA MEC HLOMUKA CONDUCTS TWO DAY VISIT OF DISASTER STRUCK AREAS IN ZULULAND

    KZN MEC for Cogta Sipho Hlomuka has embarked on a two-day visiting to the Zululand District Municipality where he will be assessing the ongoing efforts to provide appropriate relief to families affected by the heavy rains that struck the northern parts of the province as a result of tropical cyclone Eloise.

     

    The District is one of the hardest-hit areas.

     

    Tomorrow, Thursday the MEC will visit communities within the eDumbe Municipality where several houses and public infrastructure was damaged by the heavy rains.

     

    On Friday, the MEC will be visiting communities within Nongoma Municipality where two fatalities were reported with a 3-year-old child still missing.
